1. Agreement to Terms
By engaging Build Smart Solutions for maintenance and repair services, you agree to be bound by these Terms and Conditions. These terms apply to all our services including plumbing, electrical work, landscaping, carpentry, and general maintenance services.
2. Service Description
Build Smart Solutions provides:
- Professional plumbing installation, repair, and maintenance services
- Electrical installation, repair, and maintenance services
- Landscaping and garden maintenance services
- Carpentry and woodworking services
- General property maintenance and repair services
- Emergency repair services (subject to availability)
3. Pricing and Payment
3.1 Quotations
All quotations are valid for 30 days from the date of issue unless otherwise specified. Prices may be subject to change based on material costs and scope modifications.
3.2 Payment Terms
Payment terms will be specified in your service agreement. Generally:
- Small repairs (under R1,000): Payment due upon completion
- Medium projects (R1,000 - R10,000): 50% deposit, balance on completion
- Large projects (over R10,000): Payment schedule to be agreed upon
3.3 Additional Costs
Any additional work required beyond the original scope will be quoted separately and requires your approval before proceeding.
4. Service Warranties
4.1 Workmanship Warranty
We provide a 12-month warranty on our workmanship from the date of completion. This warranty covers defects in our installation or repair work but does not cover normal wear and tear or damage caused by misuse.
4.2 Parts and Materials
Parts and materials are covered by manufacturer warranties. We will facilitate warranty claims where applicable but are not responsible for manufacturer defects.
5. Liability and Insurance
5.1 Insurance Coverage
Build Smart Solutions maintains comprehensive public liability insurance. We are fully insured for work-related damages and injuries.
5.2 Limitation of Liability
Our liability is limited to the cost of the specific service provided. We are not liable for consequential damages, lost profits, or indirect losses.
6. Client Responsibilities
As our client, you agree to:
- Provide safe and reasonable access to work areas
- Ensure pets are secured during service visits
- Disclose any known hazards or special requirements
- Make timely payments as agreed
- Provide accurate information about your property and requirements
7. Cancellation Policy
7.1 Client Cancellation
You may cancel services with 24 hours notice for scheduled appointments. Cancellations with less than 24 hours notice may incur a cancellation fee.
7.2 Our Cancellation Rights
We reserve the right to cancel or reschedule services due to weather conditions, safety concerns, or other circumstances beyond our control.
8. Health and Safety
Build Smart Solutions is committed to maintaining high health and safety standards. We comply with all relevant health and safety regulations and expect clients to maintain safe working conditions.
9. Dispute Resolution
9.1 Initial Resolution
Any disputes should first be addressed directly with our management team. We are committed to resolving issues promptly and fairly.
9.2 Formal Disputes
If a dispute cannot be resolved through direct communication, it will be subject to South African law and the jurisdiction of South African courts.
10. Privacy and Data Protection
We respect your privacy and handle all personal information in accordance with applicable privacy laws. We only collect information necessary for providing our services and do not share personal information with third parties without consent.
11. Emergency Services
Emergency services are provided on a best-effort basis and may incur additional charges. Emergency rates apply for after-hours, weekend, and holiday services.
12. Intellectual Property
All designs, plans, and proprietary methods remain the intellectual property of Build Smart Solutions unless otherwise agreed in writing.
13. Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, government actions, or other force majeure events.
14. Modifications to Terms
These terms may be updated from time to time. We will notify clients of significant changes and post updated terms on our website. Continued use of our services constitutes acceptance of modified terms.
